IN ACCORDANCE WITH TOWN CODE SECTION 2-4-1 AND ARIZONA REVISED STATUTES SECTION § 38-431.02,

NOTICE IS HEREBY GIVEN TO MEMBERS OF THE QUARTZSITE COMMON COUNCIL AND TO THE GENERAL PUBLIC THAT THE QUARTZSITE COMMON COUNCIL OF THE TOWN OF QUARTZSITE, ARIZONA, WILL HOLD A REGULAR MEETING OPEN TO THE PUBLIC ON TUESDAY, JUNE 14, 2011 AT 4:00 PM, AT THE QUARTZSITE MUNICIPAL CENTER, 465 N. PLYMOUTH AVE., ¼ MILE NORTH OF MAIN STREET (B-10). SEE AGENDA WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN. MEMBER(S) OF THE COMMON COUNCIL WILL ATTEND EITHER IN PERSON OR BY TELEPHONE CONFERENCE CALL.

INFORMATION CONCERNING THE COUNCIL’S AGENDA FOR THE MEETING MAY BE REVIEWED AT THE QUARTZSITE MUNICIPAL CENTER. THE PUBLIC MAY OBTAIN A COPY OF THE AGENDA DURING REGULAR BUSINESS HOURS AT THE QUARTZSITE MUNICIPAL CENTER, 465 N. PLYMOUTH AVE., ¼ MILENORTH OF MAIN STREET (B-10), QUARTZSITE, ARIZONA.

NEW BUSINESS:

061411-4. Discussion and possible action to censure Mayor Ed Foster for

abuse of office. On June 1, 2011, Mayor Ed Foster called a special

meeting of the Quartzsite Town Council for “discussion and possible action regarding investigation by the Arizona Ombudsman’s Office”. This agenda violated A.R.S. §38-431.02(H) item by being so vague that it failed to place the general public on notice of the specific subject of the item i.e., that the investigation by the Arizona Ombudsman involves a request for record made by Ed Foster and of the proposed possible action to be taken, and deprived members of the general public who may have wished to be present for the meeting had they known the precise nature of the agenda item with lawful notice of the meeting. Further, inasmuch as Mayor Ed Foster had a direct proprietary interest in any “possible action” to be taken by the Council with regard to this matter, Mayor Ed Foster’s personal interest conflicted, or at a minimum could give the appearance of an apparent conflict, with the interests of the town of Quartzsite and of the Quartzsite Town Council creating an appearance of an abuse of office which tends to undermine the credibility of the Quartzsite Town Council.

This agenda violated A.R.S. §38-431.02(H) item by being so vague that it failed to place the general public on notice of the specific subject of the item i.e., what the alleged problem at the Quartzsite Police Department was or of any proposedpossible action” to be taken, and deprived members of the general public who may have wished to be present for the meeting had they known the precise nature of the agenda item with lawful notice of the meeting. Further, inasmuch as Mayor Ed Foster had a direct proprietary interest in any “possible action” to be taken by the Council with regard to this matter, being the subject of appending criminal prosecution wherein multiple officers and the Chief of the Quartzsite Police Department are witnesses against Mayor Ed Foster, Mayor Ed Foster’s personal interests conflicted, or at a minimum could give the appearance of an apparent conflict, with the interests of the Town of Quartzsite and of the Quartzsite Town Council creating an appearance of an abuse of office which tends to undermine the credibility of the Quartzsite Town Council.
